Experience and reputation as a trial court judge.
As a Pro Tempore Judge for Washington County I have sat on dockets ranging from restraining order matters to small claims. While sitting on a case from the Family Abuse Prevention Act (FAPA)/ Elderly Persons and Persons with Disabilities Abuse Prevention Act (EPPDAPA) docket I presided in the matter of Sacks v Hanington also known as I.R.S. v Hanington in which the respondent raised a challenge to EPPDAPA on the grounds it unconstitutionally infringed on the rights of free speech under the First Amendment and Oregon Constitution.
In my handling of the hearing I established a record that was extensive in detailed testimony and arguments. In addition, after the hearing but prior to my ruling, had the attorneys for both parties brief me on the constitutional question and after that issued a letter opinion recognizing the constitutional issue and setting up it for appellate court review. The Oregon Court of Appeals in I.R.S. v Hanington, (319 Or App 805 2022), acknowledged the record I created and my intention of seeking their review and ended up affirming my ruling.
In addition to serving as a pro tempore judge in Washington County, I was considered by several governors for appointment to open positions on the county’s circuit court to the point of interviews with the governors’ staff and advisors.
